WALLS CRACK WHEN ROOF FALLS
A business policy covered the collapse of a roof. The same policy excluded coverage for ‘cracking’ and ‘bulging’ of walls. After a roof collapsed, the walls bulged and cracked. The insurance company refused coverage as these were excluded items. The court ruled the damages should be covered since these conditions, while explicitly excluded, resulted only after the collapse of the roof, which was a covered risk under the policy.
Why This Is Important . . .
If a covered risk creates a chain reaction of events, including excluded damages, your policy might pay despite the exclusion.
